These General Conditions of Sale are governed by the Consumer Code (Legislative Decree no. 206/2005), section II, Distance contracts (articles 50 – 67) as amended by Directive 2011/83 EU implemented by Legislative Decree of 3 December 2013 and by the rules on electronic commerce (Legislative Decree no. 70/2003) and apply to the sale of products via Internet, as identified and listed on the Website. The Customer is invited to print or keep these General Conditions in the preferred manner. In case of changes to the General Conditions, the Purchase Order (hereinafter "Purchase Order") will be subject to the General Conditions published on the Website at the time the Order is sent by the Customer. By sending the order, the Customer declares to have read, understood and accepted these Conditions of Sale.

The conditions of sale regulate distance purchases of goods offered on the sprayground.eu website. The customer by submitting his order on the website accepts the following conditions and declares to have read them.
1) * Shippings
Sprayground.eu uses the best delivery companies in the industry to ensure that your order is delivered on time.
Free shipping from €60 EUR all over the Europe.
No taxes / No customs duties (except not CEE States).
For non-EU countries, taxes and customs duties are the responsibility of the customer.
The shipment will be carried out after receiving the payment. (except for cash on delivery).
We sell throughout Europe except the Greece, Cyprus.
Delivery times may vary if the recipient's address is located in a remote area and / or island.
Delivery times are calculated from the day of processing.
Factors such as postal or courier delays, logistical problems, adverse weather conditions or the inability of our couriers to reach the recipient, at the delivery address provided when ordering, for incomplete or inaccurate data, may also affect the punctuality of deliveries.
We do our best to ensure that orders are delivered by the scheduled dates, but, on rare occasions, there may be delays in deliveries, particularly during some busy periods (sales and holidays).
Express Shipping:
Express delivery is available from Monday to Friday.
Orders placed after 12 noon will be delivered within 2 working days after processing.
No deliveries are made at weekends.
Orders placed after 12:00 noon on Fridays will be processed and shipped on Mondays.
If your delivery date coincides with a holiday, your order will be delivered on the first available working day.
No deliveries are made on national holidays.
Any delays or non-deliveries by the courier are not directly attributable to ZES.
We will do everything possible to keep you updated on delivery and you will still be able to track your package through the shipping number to be entered on the courier's website.
We do not ship to PO Boxes but only to physical addresses.
Shipping costs, where provided, must be added to the price of the product and can be viewed during checkout and hange according to product weight:

2) Prices
The prices of the products displayed are VAT included and can be changed at any time.
In addition, during checkout, before payment, the total cost of the order will be summarized, which can be modified or totally canceled.
Sprayground.eu is not for B2B customers but is a website for B2C customers. Therefore, no tax documentation is issued for companies (e.g. invoices with separate VAT, credit notes, etc.).
3) Liability and warranty
Zucchero e Scimmie S.R.L. is not responsible for any damage or loss, direct and / or indirect, from the sale of the items proposed in the published catalog, nor for delayed and / or non-delivery of the product, nor for any other fact not directly attributable to our company.
Zucchero e Scimmie S.R.L. assumes no responsibility for loss of objects after delivery, nor for damages due to the use of clothing, footwear and accessories.
The warranty terms applied are those provided by the manufacturer. It is the customer's responsibility to verify the quantity and good condition of the goods at the time of delivery.
When the Customer finds that the goods are damaged or do not comply with the quantities ordered then the same must report it to the carrier and sign the delivery document with reserve as well as inform Zucchero e Scimmier S.R.L. within 3 days of receipt of the shipment. Zucchero e Scimmie S.R.L. will provide (verified that the Product (s) subject to Return is / are intact , inserted in the original packaging, complete in all its parts, including packaging and accessory documentation) to the possible replacement of the missing or damaged goods and in accordance with the Purchase Order made.
4) Payments
Payments are administered by LDA Fashion srl VAT 14345861000 - Via delle Genziane 13E – 00012 Guidonia (RM) IT.
The payment of your order can be carried out in the below methods:

Cash on delivery (only for Italy) – Cash payment to the courier; additional cost of €4,90; For orders up to €400. (not available for pre-order items).
All Credit and Debit card transactions are debited at the point of purchase
5) Returns and refunds
Right of withdrawal, returns and refunds
The consumer has the right to withdraw from the contract, without giving any reason, within 30 days from the date on which they received the order.
The 30-day period is a more favorable condition granted by Sprayground.eu compared to the minimum period set out in Italian Legislative Decree no. 206/2005 – the Consumer Code.
How to exercise the right of withdrawal
To exercise the right of withdrawal, you can use the online function available at the following link: WITHDRAW FROM THE CONTRACT.
After filling out the form, the customer must click the "CONFIRM WITHDRAWAL" button. Withdrawal is considered exercised at the moment the form is submitted.
Sprayground.eu will send, without undue delay, to the email address provided by the customer, a confirmation of receipt containing the data submitted and the date and time of transmission.
Alternatively, the customer may communicate their decision to withdraw by means of an explicit statement sent to customercare@sprayground.eu, indicating their name, order number, and the items concerned.
Returning products
After communicating the withdrawal, the customer must return the products without undue delay and, in any case, within 14 days of the date of the communication, following the instructions received from Sprayground.eu.
The return is not free of charge and is at the customer's expense, including any size exchanges relating to the same order.
The above conditions do not apply in the case of an incorrect, defective, or non-conforming product, for which the protections provided under the legal guarantee of conformity remain unaffected.
Condition of returned products
The customer is asked to return the product complete, with the original tags and, where applicable, with its original packaging.
The customer is liable only for any diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics, fit, and functioning of the product.
The absence or damage of the original packaging does not automatically result in the loss of the right of withdrawal, but may be taken into account when assessing any diminished value of the product.
Refund timing and method
Sprayground.eu will refund all payments received from the customer, including any standard delivery costs (based on the least expensive standard delivery option offered at the time of purchase), without undue delay and in any case within 14 days from the date on which the withdrawal communication was received.
Any additional costs resulting from the customer's choice of a delivery method more expensive than the least expensive standard delivery offered by Sprayground.eu will not be refunded.
Sprayground.eu may withhold the refund until the returned products have been received, or until the customer has provided proof of shipment, whichever occurs first.
The refund will be issued using the same payment method used for the purchase, unless otherwise expressly agreed with the customer, and provided that the customer incurs no costs as a result of the refund.
Cash on delivery
Sprayground.eu reserves the right to make cash on delivery payment unavailable to users who have repeatedly refused delivery of orders without justified reason and without having first contacted customer service.
6) B2B
Sprayground.eu deals exclusively with B2C customers, not B2B customers. B2B purchases may be cancelled without prior notice.
7) Product Availability
Sprayground.eu reserves the right to accept or not the orders that will be placed and in any case until the goods are out of stock. In case of non-acceptance of the order (eg: Product not available), following an information email, we will propose the re-crediting of any amounts paid or the choice of an alternative product.
8) Use of images
The images pubblished on the Sprayground.eu website are the property of Zucchero e Scimmie S.R.L. Any use of these images, not authorized by a written consent by Zucchero e Scimmie S.R.L will be prosecuted in accordance with the law.
9) Technical Information
The technical information included in the product details are obtained from the information provided by the manufacturer.
Therefore, Sprayground.eu reserves the right to modify / adapt, where it deems it appropriate for descriptive purposes, the technical information of the products in the catalog.
As an authorized reseller of all the brands on the website, sprayground.eu guarantees the authenticity of each item.
10) Sensitive data
Your credit card details are managed by the PayPal service. The company Zucchero e Scimmie S.R.L. and those who work won’t be aware of this information. If you choose PayPal as a payment method, carefully read the terms of service on the reference website.

12) Alternative dispoute resolution (ADR) /On line dispute resolution (ODR)
EU Regulation no. 524/2013 and Legislative Decree no. 130/2015 have introduced legislation aimed at facilitating the out-of-court settlement of disputes between consumers and traders relating to a product or service purchased online. To this end, a European Online Dispute Resolution platform (so-call ODR platform) has been created, which can be consulted at http://ec.europa.eu/consumers/odr/. Through the ODR platform, the consumer can send a complaint relating to a contract concluded online with Zucchero e Scimmie S.R.L.. The steps are 4:
– creation and sending of the complaint
– agreement on the resolution
– processing of the complaint by the resolution entity
– solution and closure of the complaint.
13) Applicable law, jurisdiction and place of jurisdiction for non-consumer users
These Conditions are subject to Italian law. For all orders from subjects who do not qualify as "consumers", all disputes relating to the interpretation and / or execution of this contract, will be the exclusive competence of the Firenze forum.
For consumer customers, it must be understood that the place of jurisdiction remains the consumer's court.
